New - Dam Safety Permit

The Maryland Dept. of the Environment Dam Safety Permits Division issues Dam Safety permits/approvals for new dams and small ponds and permits for alterations to existing dams and small ponds. The major goal of this permit is to ensure that dams are built and operated properly to protect public safety. Anyone who wishes to construct, reconstruct, repair, or alter a dam, reservoir, or similar waterway obstruction must obtain a permit prior to beginning any work (certain small ponds are exempt from this permit). Projects that impact the floodplain, wetlands, or waterways also require a separate Joint Permit Application.

The major goal of this permit is to ensure that dams are built and operated properly to protect public safety. Anyone who wishes to construct, reconstruct, repair, or alter a dam, reservoir, or similar waterway obstruction must obtain a permit prior to beginning any work (certain small ponds are exempt from this permit). Projects that impact the floodplain, wetlands, or waterways also require a separate Joint Permit Application . Dams that meet the criteria below are referred to as “small ponds”: Drainage area to the pond must be less than 640 acres; and The height of the pond (measured from the upstream toe to the top of dam) must be less than 20 feet; and The dam must be a "low hazard" structure, the failure of which is not likely to cause loss of life or property damage. (Refer to MDE Guidance for Completing a Dam Breach Analysis for Small Ponds and Dams in Maryland); and The pond must have a maximum storage volume less than 50 acre-feet.
